These Terms and Conditions govern Your use of the Service and Your purchase of Products from the Company. By purchasing or using Our digital products, You agree to these terms.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Company (referred to as either “the Company”, “We”, “Us” or “Our”) refers to David V. Kimball and David V. Kimball LLC, collectively.
  • Products means the digital products sold by the Company, including premium Astro website themes and any related files, code, or materials provided upon purchase.
  • Service refers to the Website and any storefront or checkout through which Products are offered.
  • Store refers to the Company’s sales platform operated by Lemon Squeezy, including checkout at store.davidvkimball.com or as otherwise designated.
  • Website refers to the Company’s website, accessible from https://davidvkimball.com.
  • You means the individual purchasing or using the Products or accessing the Service.

Products

The Company sells digital products only: premium Astro website themes and related assets. Delivery and access (e.g., download links, license keys, or other fulfillment) are provided as described at the time of purchase and in accordance with the Store’s processes. Products are delivered electronically; no physical goods are shipped.

License

Subject to Your payment and compliance with these terms, the Company grants You a non-exclusive, limited, non-transferable license to use the purchased Product(s) for Your own projects in accordance with the scope stated on the product page at the time of purchase (e.g., one production site per license, or as otherwise specified). You may not:

  • Redistribute, resell, sublicense, or share the Product(s), download links, or license keys with any third party.
  • Make the Product(s) available for free or for sale on any marketplace, theme/plugin directory, or similar platform.
  • Remove or alter any attribution, copyright notices, or license terms included in the Product(s).

Any use beyond the granted license is prohibited and may result in termination of Your license and pursuit of available remedies.

Axis Theme

The following terms apply specifically to the Axis premium Astro theme:

  • Each purchase includes one license key for your use only.
  • You may use Axis on unlimited personal and commercial projects you own or operate.
  • Lifetime updates are included. Updates are delivered via pnpm run update and require a valid license key. “Lifetime” refers to the lifetime of the product, not a guarantee of perpetual development.
  • The Axis Settings plugin and Tag Mirror plugin are proprietary software provided as part of your purchase. They may not be redistributed separately from the Axis theme.
  • License keys must not be shared. Keys found to be shared or abused may be revoked.
  • Community support is available through my Discord server. Custom development, debugging your code, or third-party integration support is not included.

Payment and Fees

Payments for Products are processed by Lemon Squeezy. By completing a purchase, You also agree to Lemon Squeezy’s terms as they apply to the transaction. All prices are in U.S. Dollars unless otherwise stated. You are responsible for any applicable taxes (sales, use, VAT, or similar) in Your jurisdiction.

Refunds

Refund requests are handled in accordance with Lemon Squeezy’s policies. Lemon Squeezy may issue refunds in cases of fraud, their error, or product violation. Otherwise, digital products are generally non-refundable once delivery or access has been provided. For payment and refund inquiries, refer to Lemon Squeezy’s documentation and support.

Prohibited Use

You may use the Products only in accordance with the license granted above and applicable law. You may not use the Products or the Service for any illegal purpose or in any way that violates Lemon Squeezy’s acceptable use or prohibited products policies.

Disclaimer

The Products and Service are provided “as is” and “as available.” To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. The Company does not warrant that the Products will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, the Company’s total liability arising out of or related to these terms or the Products shall not exceed the amount You paid for the Product(s) giving rise to the claim. In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages.

Changes to These Terms

We may update these Terms and Conditions from time to time. We will post the updated terms on this page and update the “updated” date. Your continued use of the Service or any purchase after changes constitutes acceptance of the revised terms. You are advised to review this page periodically.
